Types of cookies used by the SWater Online website and how to manage consent, pursuant to Article 122 of the Italian Privacy Code and the 10 June 2021 Guidelines of the Italian Data Protection Authority.

This Cookie Policy describes the types of cookies and similar technologies used on the SWater Online website and application (the "Service") and is provided in compliance with Article 122 of Italian Legislative Decree 196/2003 (Italian Privacy Code), the Guidelines of the Italian Data Protection Authority of 10 June 2021 on cookies and other tracking tools, as well as Directive 2002/58/EC ("ePrivacy") and Regulation (EU) 2016/679 ("GDPR").

(hereinafter, "ELERIA" or the "Controller").

2. What cookies are

Cookies are small text files that websites visited by the user send to the user's terminal (computer, tablet, smartphone), where they are stored to be retransmitted to the same site on subsequent visits. Similar technologies (by way of example: web storage, local storage, session storage, session identifiers) produce comparable effects and, where used, are subject to the same rules.

The Italian Data Protection Authority Guidelines essentially distinguish two categories:

  • Technical cookies, used for the sole purpose of carrying out the transmission of a communication or to the extent strictly necessary to provide a service requested by the user. No consent is required.
  • Profiling cookies, aimed at creating profiles relating to the user and used to send personalised advertising messages. They require the prior, free, specific, informed and unambiguous consent of the data subject.

3. Types of cookies used by SWater Online

In summary: SWater Online uses technical cookies only. No profiling cookies, third-party analytics cookies, advertising cookies, social-network cookies, retargeting cookies or other user-tracking technologies are used.

Pursuant to Article 122 of the Italian Privacy Code and to the Guidelines of the Data Protection Authority, no user consent is required for the installation of such cookies. The obligation to provide this information notice remains.

3.1 Strictly necessary technical cookies

These cookies are essential for the operation of the Service and to allow the user to browse and use its features. Without them, it is not possible to authenticate, to keep the working session active, or to ensure the security of the exchanges.

Typical examples:

  • session and authentication cookies;
  • cookies containing the refresh token (in httpOnly and secure form);
  • cookies containing the CSRF token, for protection against cross-site request forgery attacks;
  • load-balancer cookies managed by the infrastructure.

3.2 Technical functionality cookies (user preferences)

These cookies store choices made by the user to improve the user experience, with no tracking or profiling purpose. By way of example:

  • interface language (Italian / English);
  • interface theme (light / dark / automatic);
  • other display preferences (e.g. sidebar state, table sorting).

These cookies are treated as technical cookies under the Italian Data Protection Authority Guidelines (para. 4.1), as they are strictly linked to choices expressly made by the user.

3.3 Analytics cookies

SWater Online does not use first-party or third-party analytics cookies (by way of example: Google Analytics, Matomo, or Plausible not configured as "cookieless"). Should analytics tools be introduced in the future, this Policy will be updated and — where required by applicable legislation — user consent will be obtained.

3.4 Profiling and third-party cookies

SWater Online does not use profiling cookies, advertising cookies, third-party cookies for marketing or retargeting purposes, tracking pixels, social plugins or third-party widgets that set cookies.

Identifiers stored in the browser's localStorage or sessionStorage are treated as equivalent to technical cookies under the Italian Data Protection Authority's Guidelines and are subject to the same rules. The list above is exhaustive at the date of publication and will be updated in case of technical evolutions of the Service.

5. Retention

Session cookies are automatically deleted on browser close. Persistent cookies remain stored on the user's device for the duration set out in the table in Article 4, except for any earlier deletion by the user.

6. Managing and disabling cookies

The user may at any time manage, limit or disable cookies via the browser settings. It should be noted, however, that disabling strictly necessary technical cookies makes it impossible to use the Service (the user will not be able to authenticate or maintain a session). Disabling functionality cookies does not compromise the use of the Service, but it does result in the loss of stored preferences.

7. Relationship with the Privacy Policy

Any personal data processed in connection with the technical cookies described above (by way of example: IP address, technical session identifiers) is processed in accordance with the Privacy Policy of SWater Online, published on the official website of the Service, to which reference is made in full for the purposes, legal bases, retention periods and rights of the data subject.

8. Amendments to this Policy

ELERIA reserves the right to update this Cookie Policy in case of technical changes to the Service, introduction of new types of cookies or regulatory developments. Amendments will be published on the official website; should consent-based cookies be introduced, the user will be informed in advance and consent will be requested in accordance with the methods provided for by applicable law.
